Who you are dealing with

Album is operated by WP FOSS LIMITED, a company registered in Kenya, trading as Album. These terms are the agreement between you and us. By buying an album or using one, you accept them.

We are registered with the Office of the Data Protection Commissioner as Data Controller and Data Processor, registration number 507-1539-1BAA.

  • Post: Laiboni Centre, 4th Floor, Nairobi, Kenya
  • Email: hello@album.ke
  • Telephone and WhatsApp: +254 709 384 200, +254 722 334 188

How we handle personal information is set out in our privacy policy, which is part of this agreement.

Monitoring. We monitor how people use all of our websites (the pages visited and, where there are accounts, sign-ins), using our own records and tools such as Google Analytics and the Meta Pixel. The full list is in the privacy policy. Non-essential cookies run only after you press Accept.

Who may buy an album

You must be 18 or over to buy an album and to be its owner. An album is a family's records, some of them sensitive, and somebody has to be able to enter a binding agreement about them.

A family album usually holds photographs of children, and often of relatives who have died. That is what it is for, and it is allowed. What is not allowed is an account held by a child, or an album used to collect images of children who are not part of your family.

You may invite anybody you choose into your album. You are responsible for who you invite and for what they can see.

What you are buying

An album on album.africa: a private place for your family's photographs, the stories behind them, your family tree, and the records a family keeps. Only the people you invite can open it.

An album here is sold together with a domain name of your choosing, registered in your name. The endings on offer are shown on the page where you buy. The section below sets out what that means, because a domain name is not like the rest of the service.

Plans and prices are shown on the page where you buy, and that page is the price. Paid yearly, the album runs for twelve months from the day you pay, with no setup fee. Paid monthly, there is a one-off setup fee and then one payment each month. Either way the price covers the album, storage, backups and help for the time paid for.

Your family’s domain name

When your album comes with a domain name, that name is registered in your name, not ours. You are the registrant. We buy it for you through our registrar and we manage it for you while you are with us.

  • You must give true details. Every registry requires the registrant's real name and contact details, KENIC, who run .ke, among them. We pass them to our registrar and to the registry for that purpose and no other. Details that turn out to be false can cost you the name, and that is the registry's decision rather than ours.
  • The registry's rules apply to you. Registering a name makes you subject to the rules of the registry that runs it. For a .ke or .co.ke name those are KENIC's registration and dispute policies, published at https://kenic.or.ke.
  • A name is not always available. A search tells you what the registry said a moment ago. The name is only yours once it is registered, which happens after you pay. If it has gone in between, we will tell you and help you choose another. If you do not want another, we refund what you paid for the name we could not get, by the way you paid, within 14 days.
  • It takes a little time. A registration is usually done within a day. Until it answers, your album works at a temporary address we give you, and moves to your own name by itself. We email you when it does.
  • Renewal. While your album is paid for, a person on our team renews the name with it. If you leave, the name is still yours: email us and we transfer it to you, to the registrar you choose, within 10 working days, at no charge.
  • If you let it expire. A domain name has its own expiry and it is the one thing we cannot hold for you. Once it lapses, anybody may register it, and we cannot get it back.
  • The registration fee is not refundable once the name has been registered, because it has been paid to the registry on your behalf. The rest of what you paid is refundable as set out below.

Paying

By M-Pesa or by card. M-Pesa payments go to WP FOSS LIMITED, paybill 4005937. Card payments are handled by our payment processor: your card number is entered with them and never reaches us.

Prices are in Kenyan shillings and include any tax that applies. If we ever have to change a price, your existing plan keeps its price until its next renewal, and we tell you at least 30 days before that renewal.

A limited-time offer lowers the price of the first year only. Paying monthly, and every renewal, are at the usual price.

A discount code changes what you pay only for the period stated when you use it. Unless the code says otherwise, renewals are at the ordinary price.

Inviting another family. Every family album has a link and a code under Settings. When a family joins through yours and pays, KES 2,000 comes off your next renewal. The credit can be used once 14 days have passed since they paid, which is the time they have to ask for a refund. There is no limit on how many families you invite, and credit you have not used carries over, with no end date. It only ever takes money off a renewal: we do not pay it out. If the payment it came from is refunded in full, the part of the credit you have not yet used is cancelled.

If a payment fails, nothing happens immediately. We write to you, and the album keeps working for the grace period below.

Renewal, reminders, and what happens if you stop paying

Nothing is ever switched off without telling you first, several times. This is exactly what our system does, not a description of what it might do.

Paid yearlyPaid monthly
We email you 30 days before the renewal date, again 7 days before, and again the day before. We email you 3 days before each payment, and on the day.
If you do not renew, the album keeps working for 30 days after the date, and we write to you twice more in that time.If a payment is missed, the album keeps working for 7 days, and we write to you again 3 days after.

After the grace period the album is made private. Nobody, including you, can open it until it is paid for. Nothing is deleted. Every photograph, story and name stays exactly where you left it, and paying brings the whole album back the same day, at the same address.

While it is private, its address shows a page saying so, with a button to renew. If you want a copy of your photographs before you decide, write to us and we will give you one. The best time to take a copy is while the album is working: Settings will give you a copy at full quality, whenever you like, as set out under "Your photographs and stories stay yours" below.

How long we hold a private album. We keep it for 12 months. If it is still unpaid then, we write to the owner one last time, and if we do not hear back within 30 days after that, we delete the album and its photographs. We would rather hold your memories than delete them, but we cannot hold them for ever and it is fairer to say for how long.

You can cancel at any time. An owner opens Settings in the album and presses Cancel my album, or writes to us. Nothing is ever taken from you automatically, so cancelling stops the renewal reminders. It does not end the time you have already paid for: the album stays open until then and afterwards closes as described above. You can change your mind until that date, in Settings or by paying again.

Refunds

If Album does not work as described, tell us within 14 days of paying and we will refund you in full. After that, we do not refund time already used, but we will always look at a genuine problem.

Where a domain name has already been registered for you, the registration fee is not part of the refund, because it has been paid to the registry. You keep the name.

Your photographs and stories stay yours

Everything you put into your album is yours. We claim no ownership of it, we do not use it to advertise, we do not sell it, and we do not use it to train anything.

You give us only the permission we need to run the service for you: to store your files, to make the copies and backups that keep them safe, and to show them to the people you have invited.

You can download a copy of your family records at any time, from Settings. You get one zip file with your photographs at full quality, a spreadsheet of their captions, dates and the people in them, your stories and tribute, and your private sections (Wishes & assets, and Family health). It does not hold your family tree, the list of your videos and the list of members. Write to us if you want those and we will send them. You do not need our help and you do not need to ask for the zip. You can take it three times a day.

Videos stay on YouTube. A video you add to an album is not stored by us. It stays on the YouTube account of the person who put it there, and we keep only the link. So a video is not in our backups and not in the download, and YouTube's own terms apply to it.

What we ask of you

Use Album for a family's own records. Do not use it to store or share anything unlawful, anything that infringes somebody else's rights, or material involving the abuse of children. Do not try to break into another family's album, and do not attack the service.

Be thoughtful about other people. An album usually holds photographs of relatives who never agreed to anything. If somebody in your family asks you to take an image of them down, take it seriously.

If we are told that something in an album is unlawful, we will look into it. We may remove that item or, if we have to, suspend the album. We tell the owner what we did and why, unless the law stops us, and they can ask us to look again.

Private sections, and after a death

Album can hold a will, funeral wishes, asset notes and health records, and can keep them sealed until a family asks for them to be released. This is a way for a family to find what they need at a hard time. It is not a legal service.

We do not draft, witness, execute or store the official copy of anything. A will in Album is a copy of a document that must be valid in its own right under Kenyan law. Take legal advice about the document itself. We are not responsible for whether it is valid or for how it is interpreted.

A release follows the waiting period and the approvals the owner set up, and every release is recorded.

Availability, backups, and things outside our control

We work to keep Album available at all times, and we back up every album nightly. We do not promise that it will never be unavailable: no honest service does. Maintenance is done at quiet hours where we can.

Backups are for putting things right after a failure on our side. They are not a substitute for your own copy, and we encourage every family to download their album, or connect their own Google Drive, so that a copy exists somewhere we do not control. Videos are the one thing our backups do not hold: they stay on YouTube, as set out above.

We are not responsible for failures caused by things outside our control, including network or power failures, the acts of another company we depend on, or the registry's own decisions about a domain name.

Partners, resellers and people who introduced you

Some families reach Album through somebody else: a partner who sells Album as their own product, a reseller, or somebody who recommended us and is paid a share. They are independent. They are not our employees, our agents or our representatives, and they cannot make promises on our behalf.

  • Anything they told you that is not in these terms or on our own pages is theirs, not ours. If the two disagree, these terms are what applies.
  • They settle their own taxes and their own obligations on what we pay them. We deduct only what Kenyan law requires us to deduct.
  • If somebody introduced you, they can see that you are their customer: your family or album name, the email address and telephone number you gave when buying, your plan and your renewal date. They cannot open your album and they never see your photographs, your stories, your family tree or your private sections.
  • You may ask us to stop showing your details to them, and we will.

If you sell Album yourself, or want to, the sections headed "If you sell Album, or send customers to it" and "Selling Album" are for you.

If you sell Album, or send customers to it

These terms are between you and WP FOSS LIMITED, trading as Album, a company registered in Kenya at Laiboni Centre, 4th Floor, Nairobi, Kenya. They apply if you introduce customers to Album, resell it, or sell it as your own product.

You can apply at album.africa/sell. These terms start when we approve you and give you a link and a code, and they replace anything said before in conversation.

Selling Album: you are independent

You are an independent contractor. You are not our employee, our agent, our partner in law, or our representative. Nothing here creates a partnership or a joint venture between us.

  • You cannot make promises on our behalf: not about price, not about what Album does, not about when something will be built. If you tell a customer something we do not say on our own pages, that is between you and them.
  • You decide your own hours, your own methods and your own costs. We do not supervise your work.
  • You settle your own taxes on everything we pay you, including income tax and, if you are registered for it, VAT. We deduct only what Kenyan law requires us to deduct, and we give you a statement of what we paid.
  • You carry your own costs: your phone, your data, your advertising, your travel.

Selling Album: who may join

  • You must be 18 or over.
  • You must give your real name and contact details, an M-Pesa number registered in your own name, and your national ID or passport number. We may also ask for a copy of your ID or passport, and for your KRA PIN, before we approve you or before we pay you. We hold them as set out in our privacy policy.
  • If you are applying as a company, you must be entitled to act for it, and we may ask for its registration.
  • We may refuse an application, and we do not have to say why.

Selling Album: applying online, your share, and the price your buyers pay

  • We read every application ourselves and answer by email, usually within 2 working days.
  • If we approve you, your share is 40% of what each family, company, school or church you bring pays us, after VAT (16%, which goes to the government) and after the cost of their domain name. It is paid on their first payment and on every renewal, for as long as they keep paying.
  • Your buyers pay our normal price. A family, a company, a school or a church that buys through your link or your code pays the full price shown on our pages, not any limited time offer, and discount codes do not apply. Never promise anybody a discount.
  • You may not earn on your own purchase, or on one paid from your own M-Pesa. A family bought with the email you sign in with is not counted as yours, and one paid from the M-Pesa number we pay you on is checked by us before any share on it is sent.
  • You may not earn on a company you own, work for or direct, or on a school or church you lead or work for. An album bought for one is not a sale of yours. We check every company, school and church album sold through you before your share on it is sent, and if it was your own, the share is not paid.
  • We may suspend your link and your code if these terms are broken. A suspended link stops working at once. We still pay what you earned honestly before then, but a payment a family makes while you are suspended, a renewal included, earns you nothing.

Selling Album: what you earn, and when

Your share is the percentage we approved you at, or agreed with you in writing, of what the customer actually pays us, excluding tax and excluding any domain registration fee we pay on to a registry. It applies to the first payment and to renewals, for as long as that customer keeps paying, unless your own agreement says otherwise.

Paid monthly, after a hold of 30 days. A month's sales are paid 30 days after that month ends, which is about the end of the following month. The hold exists because a customer can ask for a refund within 14 days, and because a payment can be reversed after it appears to have cleared. We would rather wait than take money back from you.

  • If a customer is refunded or their payment is reversed, the share on it is reversed too. If it has already been paid to you, it comes off your next statement.
  • We pay by M-Pesa to the number you give us, unless we agree otherwise. Getting that number right is your responsibility.
  • Your own page shows every sale, what is owed and what has been sent, and you can download it.
  • If this agreement ends, we still pay you everything already earned, on the usual schedule.

Selling Album: how a customer becomes yours

A customer is yours if either of these is true, and we will always tell you which:

  • They followed your link and bought within 365 days. We remember your link in a cookie on their browser for that long.
  • They typed your code when buying.
  • Your link works for company, school and church albums too, under the same name on business.album.ke, school.album.ke and church.album.ke, and so does your code.

Say this to yourself before you start. Somebody who hears about Album from you, then types our address directly without your link and without your code, is not attributed to you. There is no way for us to know they were yours. That is why the code belongs in every video description and every post.

If a customer arrives with a code and a cookie from two different people, the code wins: it is the more deliberate act. If two of you have a genuine claim to the same customer, tell us and we will look at what the records show.

We show you our own figures for how often your link was opened, day by day, and we encourage you to publish it through a counter of your own and compare. A shortener counts requests we leave out, such as search engines and link previews, so its figure usually reads a little higher than ours.

Selling Album: the customers you introduce

You can see, for your own customers only: their family or album name, the email address and telephone number they gave when buying, their plan, whether they have paid, and when they renew. You can never open their album or see their photographs, their stories, their family tree or their private sections.

Those details are given to you to support that customer and for nothing else. You must not add them to a marketing list, sell them, pass them on, or use them for another product. You must keep them safe and delete them if we ask, or if the customer asks. Kenyan data protection law applies to you as well as to us.

Selling Album: how you may sell

  • Say only what is true, and what our own pages say. Do not invent features, prices, or dates, and never promise a discount.
  • Do not pretend to be us. Do not use our name in a way that suggests you are Album, do not register domain names containing our name, do not bid on our name in advertising, and do not set up accounts or pages that look like ours.
  • No spam. No bulk unsolicited email or SMS, no WhatsApp broadcasts to people who did not ask, and nothing that breaks the rules of the platform you are posting on.
  • Do not buy your own product through your own link to earn a share on it, and do not offer somebody part of your share for doing the same.
  • Make it clear you are paid, if anybody asks. It costs you nothing and it is increasingly what the law expects.
  • Use our logo and words as we supply them. Do not alter them.

Ending this agreement

You may stop at any time, as above. We may suspend or end an album if it is not paid for, if these terms are broken seriously or repeatedly, or if the law requires it. Except where the law prevents us, we tell you first and give you a fair chance to put it right and to export your photographs.

If we ever stop offering Album, we will give at least 90 days' notice, make it possible to download every album in full, and refund the unused part of what you have paid.

Our responsibility to you

We are responsible to you for losses we cause by failing to take reasonable care. Where the law allows us to limit that, our total liability for any claim is limited to what you have paid us in the twelve months before it arose.

We are not liable for losses that were not foreseeable, for business losses, or for loss of data where you had the means to keep your own copy and did not. We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit.

Changes to these terms

We may change these terms. If a change matters to you, we will tell you by email at least 30 days before it takes effect, and you may cancel and be refunded for the unused time if you do not accept it. Small corrections take effect when published, and the date at the top of this page always says when it last changed.

Changed on 29 October 2026: a company, a school or a church that buys through a seller pays our normal price, as a family does. No family's price and no share changed.

Changed on 19 October 2026: sellers can sell school and church albums too, on school.album.ke and church.album.ke, at the same share, and earn nothing on a school or church they lead or work for. No price or share changed.

Changed on 18 October 2026: sellers can sell company albums too, on business.album.ke, at the same share, and a company they bring pays the one price shown there. No price or share changed.

Changed on 16 October 2026: what the download holds and what it does not, that videos stay on YouTube, the credit for inviting a family, that a limited-time offer lowers the first year only, which sections are for sellers, and how soon a seller is paid. No price or share changed.

Changed on 13 October 2026: how to cancel from Settings, and plainer words on who renews a domain name, how we transfer it to you, and how we refund a name we could not get. No price or share changed.

Law, and how a disagreement is settled

These terms are governed by the laws of Kenya.

If something goes wrong, write to us first at hello@album.ke. Almost everything is settled that way. If it is not, we will try in good faith to agree a solution within 30 days, and failing that the matter goes to arbitration in Nairobi under the Arbitration Act 1995, before a single arbitrator. Nothing here stops either of us from asking a court for an urgent order, or stops you from complaining to the Office of the Data Protection Commissioner.

The rest

  • If part of these terms turns out to be unenforceable, the rest still stands.
  • Not enforcing something once does not mean giving it up.
  • You may not transfer your agreement to somebody else without asking us. We may transfer ours if the business is sold, and your rights are unaffected.
  • These terms and the privacy policy are the whole agreement between us about Album.
  • Nobody other than you and us has rights under this agreement.
